Update # 51 - September 12, 2011

 

The Courts have recently approved a Deficient Claim Deadline Protocol.  If there is insufficient information to approve a claim, the Administrator will issue a deficiency letter which sets out a deadline by which all of the deficiencies must be cured.  The Deficiency Deadline is 90 days from the date of the Deficiency letter.  To view the complete Court Approved Deficient Claim Deadline Protocol please refer to the Court Approved Protocol section of the Web site.

 

A claimant may, prior to the Deficiency Deadline request and extension of their deficiency deadline.  An extension of the deadline may be granted only with leave from the Court.  A request for an extension to the deficiency deadline must be submitted to the Administrator in writing using the ‘Request Form - Deficiency Deadline Extension’.  The claimant must set out the steps the steps taken to cure the deficiencies, the reason why the deficiencies have not been cured and the steps the claimant proposes to take to cure the deficiencies.    To view and download the ‘Request Form - Deficiency Deadline Extension’ please refer to the Claim Application Section of the Web Site.

Update #33 - May 5, 2010

JUNE 30, 2010, is the first claim deadline for submitting an application for a HCV Infected Class Member who is alive. The application must be delivered to the Administrator by this date i.e. June 30, 2010.

 

Section 5.01 of the Settlement Agreement states:

 

5.01 First Claim Deadline

 

(1) Except as otherwise expressly provided in this Agreement, the Administrator shall not consider an application made for the first time after June 30, 2010 under this Agreement except:

 

 a) where a Class Member was infected with Hepatitis C after July 1, 1990 and fails to submit an application by no fault of their own; or

 b) …

 c) where an application is made up to one year after the applicant attains his or her age of majority; or

 d) where an application is made within three years following the date upon which the HCV Infected Class Member first learned of his or her infection with HCV as a result of receiving Blood in the Class Period or being infected by a Class Member who received Blood in the Class Period, and the Court having jurisdiction over that person grants them leave to apply for compensation.

Next month, AUGUST 2009 (or three years after the death, whichever event is the last to occur) is the deadline to submit an application for a HCV Infected Class Member who has died.

The deadline to submit a family member application is one year from the date of approval of the HCV Infected Class Member’s file or within one year of the family member reaching age of majority (whichever event is the last to occur).

As of January 16, 2009 the Administrator has received 9,098 claims from HCV class members and has approved or paid 5,235 (58%).

To date, over 398 million dollars in compensation has been paid to class members.

The Administrator is making every effort to maintain the most efficient possible processing of claims as they are received. Claimants should of course be aware that it is necessary that infection with hepatitis C through the blood system be established before claims can be approved and that where trace backs are necessary, a further period of time is required to complete that process. Claimants can assist in expediting payment by ensuring that all supporting material is included with their applications and that the applications themselves are properly completed.


Update #16 – November 25, 2008

Compensation if the HCV Infected Class Member is Deceased

Compensation varies depending on when the death occurred.

If the person died before January 1, 1999, please refer to Section 3.02 of the Settlement Agreement (Schedule C2 is not applicable).

If the person died on or after January 1, 1999, please refer to Section 3.03 of the Settlement Agreement and Schedule C2.

If the person was alive at time of application but is now deceased, please refer to Schedule C1 (funeral expense compensation is not applicable).


Update #15 – June 24, 2008

The Government of Alberta has agreed to settle a Class Action lawsuit commenced on behalf of people who became infected with the Hepatitis C virus from receiving Blood and Blood Products in Alberta prior to January 1, 1986, or between July 2, 1990, and September 28, 1998. People primarily or secondarily infected with Hepatitis C as a result of Blood received in Alberta prior to January 1, 1986, or between July 2, 1990, and September 28, 1998, need only apply under the Federal Settlement of this same lawsuit approved by the Court in 2007. Spouses, children under 21 years of age of infected Class Members, and dependants of infected Class Members whose death was caused by their infection with the Hepatitis C virus may also apply for compensation.

Update #14 – May 12, 2008

This Release has been approved by the Courts. It is natural that those affected by a serious disease such as hepatitis C would wish to be compensated, and not want to wait indefinitely for that compensation to be paid.

As the administrator of the pre 1986, post 1990 Hepatitis C settlement, Crawford Class Action Services’ primary concerns are to ensure that all claimants are treated fairly, that claims for compensation are processed as expeditiously as possible, and that payment reaches the claimants at the earliest possible date.

At the same time, Crawford must ensure that the requirements of the settlement are met before payment is made. Our highly trained and professional staff make it a priority to respond to claimants questions as quickly as possible. Our call center has in fact responded to over 28,000 calls since August of last year.

As of May 2, 2008, Crawford has received 1664 completed claims from HCV class members and has approved or paid 755 of them, approximately forty-five percent of the total.

Claimants can be assured that Crawford is making every effort to maintain the most efficient possible processing of claims as they are received. Claimants should of course be aware that it is necessary that infection with hepatitis C through the blood system be established before claims can be approved and that where trace backs are necessary, a further period of time is required to complete that process. Claimants can assist in expediting payment by ensuring that all supporting material is included with their applications and that the applications themselves are properly completed.

To date, over 82 million dollars in compensation has been paid out and that total will exceed 100 million dollars within the next several weeks.

Update #13 – February 1, 2008


The Pre-86/Post-90 class action settlement is a court supervised administration. The administrator is appointed by the court, is supervised by the court, and reports to the court. The administrator is not authorized to release any information about this settlement administration unless authorized by the court. Any authorized information available will be posted on this web site.

Update #12 – December 31, 2007

Payments are now being made and some claimants received payment in December.

The administrator is now issuing Approval Letters.


Update #10 – November 15, 2007

The Administrator is actively evaluating a large volume of claims. The Settlement Agreement does not provide deadlines on processing; however, the Administrator will begin issuing approval letters in November 2007. Approval letters and Releases will be issued on all approved claims. Once the Administrator has received a completed Full and Final Release by the third business day of the month, compensation will be issued within the last ten (10) business days of said month. Claims approved and compensated in 2008 will be indexed.

The Protocols are now posted on the Web site. They have been approved by all the Courts.


Update #8 – August 30, 2007

Even though you met the eligibility criteria in the provincial program or the Red Cross Settlement, you do not automatically qualify for this program. For example, a traceback procedure will be initiated. If all the donors are negative, your claim will be rejected. We invite you to refer to the definition of “Blood” to confirm whether or not you have received a blood product as defined in the Settlement Agreement.

You must obtain and submit additional documents as requested. It is the responsibility of the claimants to obtain these documents.

Traceback procedures
A traceback (a targeted search for infected donors conducted at the direction of the Administrator by Canadian Blood Services / Héma Québec) is needed before we can make a decision on a claim. Please do not call Canadian Blood Services. As long as all of the required information and documentation we require is submitted, our traceback coordinator will initiate the traceback. You will be notified of the search results as soon as they become available.
(This is not applicable to Primarily-Infected Hemophiliacs.)

If you have been approved by KPMG for The Red Cross Settlement, but have not received compensation, you must call the Administrator (Crawford Class Action Services) to register and to receive forms. Our toll-free number is 1-866-334-3361.

CLAIM APPLICATION

The Administrator understands that everyone is anxious to obtain a claim application package. To hopefully help make the process easier for you, the following describes how you can access a claim application package.

#1. Persons who received compensation under the Red Cross Settlement

The Pre86Post90 Hep C Administrator has received from the Administrator of the Red Cross Settlement, under the authority of Court Orders, each Red Cross class member’s personal details and mailing address (current as of August 3, 2007) relating to those persons who “received compensation” under the Red Cross Settlement.

As such, those persons who “received compensation” under the Red Cross Settlement do not need to do anything at this time. A claim application package and copy of the Final Notice of Settlement will be mailed to you on or about August 17, 2007.  Please allow one week for delivery. If you do not receive a claim application package within that period, please contact the Administrator’s toll free line 1-866-334-3361 and a claim application package will be sent to you.

#2. Persons who DID NOT receive compensation or participate in the Red Cross Settlement.

You may download the claim application package directly from this website. Click on Claim Application.

Those persons who do not have a computer or access to the Internet may call the Administrator’s toll free 1-866-334-3361, register and a claim application package will be mailed.
